OATH and ECB violations: how NYC summonses are decided

The Office of Administrative Trials and Hearings is where New York City summonses are decided. Its Hearings Division took over the work of the Environmental Control Board, which is why these are still called ECB violations. A summons has a hearing date, and what you do before that date determines what it costs.

What OATH is and is not

OATH is a tribunal, not an enforcement agency. It does not inspect buildings or issue summonses. It hears the summonses other agencies issue and decides whether the charge is sustained and what penalty applies.

Summonses reach OATH from a long list of agencies — the Department of Buildings, the Fire Department, Sanitation, the Department of Health and Mental Hygiene, the Department of Environmental Protection and others. For property owners, DOB and FDNY are the two that matter most.

The historical name causes confusion. The Environmental Control Board was folded into OATH, so "ECB violation", "OATH summons" and "OATH/ECB violation" all refer to the same kind of thing. Nothing about an ECB violation is specifically environmental.

Your options when a summons arrives

All of them have the same deadline: the hearing date on the summons. Doing nothing is not one of them.

Admit and pay
Appropriate where the charge is correct and not worth contesting. Fastest route to closing the matter, though it does not by itself resolve any underlying DOB violation.
Admit with an explanation
Accepts the charge but asks the hearing officer to take circumstances into account on penalty. Evidence that the condition has been corrected is the usual substance.
Contest it
Dispute the charge. OATH offers hearings in several formats — in person, by telephone, online and by written submission — so attending does not necessarily mean travelling.
Correct and certify where the charge allows
Some charges have a cure period during which correcting the condition and filing proof disposes of the summons or reduces the penalty. Whether one is available is stated on the summons.

Common questions

Is an ECB violation the same as an OATH summons?

Yes, in practice. The Environmental Control Board became part of OATH, and the two terms are used for the same thing. Older documents and some systems still say ECB.

Do I have to attend in person?

No. OATH provides hearings by telephone, online and by written submission as well as in person. The format matters less than responding at all.

Can somebody attend on my behalf?

Yes. An attorney or an authorised representative can appear. OATH publishes who may represent a respondent and what authorisation is needed.
