DOB violation or ECB violation? The difference that changes what you do

A DOB violation is an administrative record against the building, cleared by correcting the condition and satisfying DOB. An ECB violation is a summons returnable at OATH: it has a hearing date, it can carry a penalty, and ignoring it produces a default judgment. Many buildings have both from the same inspection.

Why one inspection produces two records
An inspector who finds an unsafe condition can both record that the building is in breach and issue a summons for it. The first is the building’s file; the second is the enforcement action.
They then move independently. Winning at OATH does not automatically clear the DOB violation, and correcting the condition does not by itself dispose of the summons. Owners who deal with one and assume the other followed are the commonest version of this problem.
The practical rule: handle the summons on its hearing timetable, because that one has a deadline that converts into money. Then make sure the underlying violation is properly resolved, because that one blocks future work.

Find the hearing date first
The summons has a date. Everything else can wait a day; that cannot. Check the status in ECB Ticket Finder and the hearing listing at OATH.
Decide whether to contest or to correct and certify
Many ECB summonses can be resolved by correcting the condition and filing a certificate of correction, sometimes with a reduced penalty. Whether that is available depends on the charge.
Deal with the DOB violation on its own terms
Resolution depends on the violation type. Some need a filing and a sign-off, some need an inspection, some need documentation. The property profile and DOB’s published guidance for that violation class are the reference.
Confirm both records changed
Go back to the property profile and Ticket Finder afterwards. Two separate confirmations, because they are two separate records.

Can an ECB violation be dismissed?
An OATH hearing officer can dismiss a summons. That is a decision on the charge; whether the underlying DOB record also clears depends on the violation and on what DOB requires to resolve it.
What is a certificate of correction?
A filing made to DOB showing that the cited condition has been corrected. For many ECB summonses it is a necessary part of resolution, and in some circumstances it supports a reduced penalty. DOB publishes what each type requires.
Why does the same violation appear twice in my search?
Usually because you are seeing the DOB violation and the ECB summons that arose from the same inspection. Compare the issue dates and the numbers: they are different records, not a duplicate.
