HPD complaints: what happens after a tenant calls 311

A tenant reports a condition, usually through 311. HPD records a complaint with one or more problem entries and schedules an inspection. If the inspector finds the condition, a violation is issued. The complaint and any resulting violation are separate records that close separately.

The lifecycle

  1. The complaint is made

    Usually through 311, by phone or online. The tenant describes the condition and the apartment. HPD records it as a complaint containing one or more specific problems, each with its own category and code.

  2. HPD attempts an inspection

    An inspector is sent. Access matters: if nobody is home the attempt is recorded and the complaint may close without an inspection having happened, which is not the same as the condition being absent.

  3. A violation is issued, or not

    If the condition is found, a violation is written at the appropriate class. If it is not found, the complaint closes with no violation. Either way the complaint record now reflects an outcome.

  4. The two records diverge

    The complaint closes once HPD has dealt with it. Any violation it produced is on its own clock and remains open until corrected and certified.

Why complaints are worth watching even when no violation follows

A complaint is the earliest signal you get. It arrives before the inspection, which means it is the one point in the process where an owner can resolve a condition before it becomes a record against the building.

Patterns matter too. Repeated complaints about the same condition in the same line of apartments usually indicate a building-wide problem being reported unit by unit, and treating each one as an isolated call is how a systemic issue becomes a dozen violations.

A cluster of complaints also attracts attention independently of whether each one produced a violation.

Can I see who complained?

No. Complainant identity is not published. You see the condition reported, the apartment and the dates.

Does a complaint automatically become a violation?

No. A violation is issued only if an inspection finds the condition. Many complaints close without one.

Can a complaint be withdrawn?

A tenant can tell HPD a condition has been fixed, but the complaint record remains part of the building’s history and any violation already issued is unaffected.
