What happens if you do not correct an HPD violation

Civil penalties accrue, HPD may arrange the repair itself and bill the owner at a rate well above market, unpaid charges can become a lien against the property, and the open violation supports tenant litigation and obstructs sales and refinancing. Nothing about it resolves with time.
What accumulates
- Civil penalties
- Attached to uncorrected violations on a schedule that depends on class and duration. HPD publishes the current amounts, and they are revised, so treat any figure you remember as out of date.
- Emergency repair charges
- Where a condition is serious and unaddressed, the city can do the work. The owner is billed, and the bill reflects emergency procurement rather than what a contractor would have charged. These are the charges that surprise people most.
- Liens
- Unpaid charges can be placed against the property and can be included in a lien sale. At that point the problem has left the compliance file and become an encumbrance on the asset.
- Housing Court
- Tenants can bring proceedings to compel repairs. Open violations are the evidence. Court orders carry their own penalties for non-compliance.
- Programme designation
- Buildings with sustained violation histories can be brought into programmes involving closer oversight and, in serious cases, work arranged by the city with the cost charged to the property.
The part owners underestimate
The direct penalty is usually not the largest number. Emergency repair charges and the cost of resolving everything at once under deadline pressure during a transaction generally exceed it, often by a lot.
There is also a compounding effect. An open violation makes the next one more consequential, because history is visible and informs how seriously a building is treated.

Will penalties stop accruing once I correct the condition?
Correcting and certifying is what stops the violation being outstanding. Penalties already incurred do not disappear because the condition was later fixed.
Is there a point at which HPD stops pursuing an old violation?
Do not plan on it. Open violations remain visible and enforceable, and they surface reliably at the moments when they are most expensive to deal with.
